BB&T Suit Continues

U.S. District Judge Claude M. Hilton has denied Branch Banking & Trust's motion to dismiss a lawsuit by a Warrenton business.

The bank's attorneys said in the motion that the plaintiff simply doesn't have a case.

In an order issued July 16, however, Hilton said Closing Connection LLC "states a claim on which recovery may be had."

The business sued the bank claiming insufficient security measures resulted in the theft of several hundred thousand dollars from the business via fraudulent wire transfers.

No further hearings have been scheduled.


Residential Burglary Reported

A residential burglary reported to the Fauquier County Sheriff's Office July 16 remains under investigation.

According to police records, someone from the 5200 block of Sumerduck Road, Sumerduck, reported a burglary with the theft of a lawn mower, chainsaw and various other tools. The estimated loss in the case was $11,625.


Private Property Damaged

Someone from the 6800 block of Crescent Road, Bealeton, reported property damage to the Fauquier County Sheriff's Office July 15.

According to police records, the caller reported that a carport was damaged. The estimated loss in the case is $1,500.


Lawn Mower Stolen

The Fauquier County Sheriff's Office received a report of a larceny in the 8700 block of James Madison Highway, Warrenton, July 17.

According to police records, the complainant reported the theft of a zero-turn lawn mower. The item is reportedly worth $7,400 and the investigation is ongoing.


Motorist Charged With DUI

Police said a Warrenton man was charged with DUI after he was involved in a motor vehicle accident July 14.

According to a Fauquier County deputy's report, the crash happened at the Fauquier County landfill at approximately 3:20 p.m.

Thomas Walter Wills, 47, of Warrenton was driving a 2002 Chevrolet Silverado when he allegedly hit a 2000 Ford Ranger from behind. The Ford Ranger, which was operated by Stephen Duncan McIntyre, 27, of Warrenton, was stopped at the checking station at the time.

McIntyre was not visibly hurt but complained of pain or momentary loss of consciousness. He was not transported to the hospital.

Wills, who was not hurt, was found to be intoxicated, police said.


Minor Injuries Reported in Wreck

Norfleet William Bonds, 53, of Culpeper, reportedly sustained minor injuries in a two-car crash July 17.

According to a Fauquier County deputy's report, the wreck happened in the area of Catlett Road and Bristersburg Road at approximately 8:29 a.m.

Bonds was driving a 1993 GMC Safari when he came over the crest of a hill and discovered traffic had suddenly stopped in front of him due to construction workers crossing the road, police said. He tried to steer toward the shoulder in order to avoid hitting stopped traffic, but when he came back into the travel lane he hit the back of a 2005 Chevrolet 4500, police said.

The Chevrolet was driven by Robert Kevin Day, 36, of Culpeper. He was not hurt.


Vehicle in Hit-and-Run Sought

Local authorities are looking for a light blue and silver vehicle that allegedly left the scene of a motor vehicle accident July 19.

A Fauquier County deputy's report indicates the incident happened in the area of John Marshall Highway and Whiting Road at approximately 5:56 p.m.

Sara Ann Kozosky, 52, of Gainesville, was driving a 2007 Harley Davidson Sportster westbound on John Marshall Highway when the unknown vehicle swerved into her lane due to excessive speed, police said.

Kozosky was forced off the right side of the road when she tried to avoid being hit. She lost control of the motorcycle in the gravel and it fell, sliding on its side before coming to rest.

The other driver also lost control of his vehicle and swerved off the right side of the road where it hit a mailbox post. The driver regained control and sped away from the scene, police said.

Witnesses said the unknown vehicle was going approximately 65 to 70 mph.

Kozosky was not visibly injured but complained of pain. She was transported to the hospital by EMS personnel, police said.
